Terms of Service

1. Acceptance

These Terms of Service (“Terms”) govern your access to and use of the Winback IQ Shopify app (“the app”, “we”, “us”). By installing or using the app, you agree to these Terms and to our Privacy Policy. If you do not agree, do not install or use the app.

2. The service

Winback IQ reads your own Shopify order history to compute an RFM (Recency / Frequency / Monetary) segmentation of your customers, surfaces the customers most likely to be slipping away ranked by the revenue at risk, and (on paid plans) syncs those segments back to Shopify customer tags and exports a worklist. The segmentation is a transparent classification of your past orders, not a churn forecast or a prediction of future behavior. The app does not use any AI/LLM service, and it does not send any emails, SMS or other messages to your customers.

3. No guarantee of results

The app is an analysis and workflow tool. We make no guarantee of any specific outcome — including any level of customer win-back, retention, engagement, conversion or revenue. Results depend on your products, offers, timing, outreach and many factors outside the app’s control. Any figures the app shows (such as “revenue at risk”) describe past spend that is exposed if you do nothing; they are not a promise of recoverable revenue.

4. Acceptable use & your outreach responsibilities

You agree to use the app lawfully. In particular:

• You must have the right to process the customer and order data in your store.
• Where the app enables you to act on segments (e.g. syncing customer tags for use in Klaviyo, Shopify Email or SMS), you are the sender and the data controller for any marketing or messaging you send. You are solely responsible for obtaining the necessary consent and for complying with all applicable anti-spam, consent and marketing laws (e.g. GDPR/ePrivacy, CAN-SPAM, TCPA) and platform policies.
• You may not use the app to violate any law, infringe others’ rights, or attempt to circumvent, disrupt or reverse-engineer the service.

5. Plans & billing

Billing is handled by Shopify through your store’s account. Current plans:

• Free — $0. Unlimited RFM analysis, the 8 lifecycle segments with revenue-at-risk, and the win-back worklist.
• Pro — $29 USD / month. Everything in Free, plus syncing win-back segments to Shopify customer tags and CSV worklist export.
• Scale — $59 USD / month. Everything in Pro, plus a daily scheduled re-analysis and auto-sync to customer tags, multi-segment sync, and an on-demand per-segment tag push.

Paid plans are recurring subscriptions billed every 30 days via Shopify until cancelled. You can change or cancel your plan at any time; charges made on a development store are test charges. Prices are exclusive of any applicable taxes and are subject to change on notice.

6. Warranty disclaimer

The app is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy or non-infringement. We do not warrant that the app will be uninterrupted, error-free or that the analysis will be free of inaccuracies.

7. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, data or goodwill. Our total aggregate liability arising out of or relating to the app is limited to the fees you paid for the app in the three (3) months immediately preceding the event giving rise to the claim.

8. Termination & changes

You may stop using the app at any time by uninstalling it from your Shopify admin; uninstalling cancels any paid subscription and triggers deletion of your stored data as described in our Privacy Policy. We may suspend or terminate access for violation of these Terms, and we may modify or discontinue features, or update these Terms, over time. Material changes will be reflected here with a new “last updated” date; continued use after a change constitutes acceptance.
